Ninety-nine per cent of Kinder Morgan Canada Ltd shareholders have voted in favour of the sale of its Trans Mountain pipeline and expansion project to the federal government for $4.5 billion however there is another road block for the federal government. The federal Court of Appeal has quashed Ottawa’s approval of the project which means the National Energy Board will now have to redo its review. The court says the Board’s review was so flawed, Ottawa couldn’t rely on it as a basis for its decision to approve the expansion. But that doesn’t seem to be the only “redo”. The court also ruled that the federal government gave the green light before engaging in meaningful consultations with First Nations groups which means the government will have to redo part of its consultations with those groups. Finance Minister Bill Morneau says the federal government is pushing ahead with its purchase of the Trans Mountain pipeline expansion despite a court ruling overturning approval of the project.
